Version 2.0 · 15 octobre 2026
Founding Partner Agreement
Short, and written to be read. The parts that matter most are the two about what you have to disclose and what you must not claim — those are the ones that carry real consequences, for you before us.
1.Who this is between
This agreement is between you (the Partner) and Jonathan Tellerain EI, a sole trader registered in France under SIREN 108 012 725, trading as Swan Club, 16 rue de Siam, 75116 Paris, France.
You are an independent contractor. This is not employment, not a partnership in the legal sense, and not an agency. You do not speak for Swan Club and cannot enter into anything on its behalf.
2.What you earn
When a member you referred takes a monthly membership, you earn 60% of her first payment. When she takes a yearly membership, you earn 40% of the yearly payment.
This is a one-time commission per member. Renewals do not earn a further commission.
The commission is calculated on the amount actually paid, excluding sales tax, and net of refunds and chargebacks. If a member refunds, the commission on that payment is reversed.
A commission becomes payable 30 days after the payment it comes from. That delay exists because a card can be disputed weeks after it clears, and paying out money we may have to claw back serves neither of us.
Payouts are monthly, with a minimum of $50. Below that, the balance rolls over to the next month.
3.How a referral is counted
A member is yours when she reaches Swan Club through your personal link and pays within 30 days of that click, on the same browser.
If two partners have a claim on the same member, the most recent click wins over an older one.
4.What your audience gets
Your code gives them their first month for $19 instead of $49. After that, the normal price.
You still earn your commission on that first, discounted payment — on what was actually paid.
5.What you get as a Partner
Free membership for as long as you are a Partner.
A Swan Map of your own city, built for you, delivered within 48 hours of your yes.
If you actually contribute places to your city — and only then — a “Curated with [your name]” credit on that city's page.
6.What you must disclose
United States law requires you to disclose that you earn a commission. This is not our preference, it is the Federal Trade Commission's Endorsement Guides, and the liability is yours as well as ours.
The disclosure must be in the content itself — on screen and, if you speak, spoken — and in the caption. “#ad” or “I earn a commission” both work. Turn on the platform's paid-partnership label as well.
A disclosure only in your bio, or buried at the end of a wall of hashtags, does not count. We check, and a partner who will not disclose is removed from the programme.
7.What you must not say
No outcome claims. Not “she met a surgeon in three weeks”, not “this got me a boyfriend”, not income or marriage claims of any kind. Swan Club is coaching: style, presence, culture, where to go. We introduce no one and we promise no one.
No invented testimonials. A story framed as an example is fine if you say it is an example. A story presented as real must be real.
Swan Club is for adults. Do not target anyone under 18.
Do not bid on “Swan Club” or its misspellings in paid search, do not run ads that impersonate Swan Club, and do not send unsolicited email or messages. Do not offer cash back or rebates for signing up through your code.
8.Ending it
Either of us can end this at any time, in writing, with no notice and no reason required.
If you end it, or we end it for any reason other than a serious breach of the two sections above, you keep the commissions already earned, including those still inside the holding period. Members who join after the end earn nothing.
If we end it because of a serious breach — undisclosed promotion, outcome claims, fabricated testimonials, fraudulent referrals — unpaid commissions are forfeited. We will tell you which one, and what we saw.
9.Your data, and ours
We keep your name, email, handles, city and the record of your acceptance of this agreement: the date, the version, and the IP address it came from. We keep it because a commission arrangement has to be provable years later.
We do not give you the names or emails of the members you referred. You see counts, not people. Their privacy is not ours to trade.
Swan Club is operated from France, so the GDPR applies to your data. You can ask for a copy or for deletion at contact@swan-club.com — bearing in mind that records tied to payments must be kept for as long as the law requires.
10.Changes, and the law that applies
This is version 2.0, dated 15 octobre 2026. If we change the terms, we publish a new version and email you. Changes apply from then on; they never reduce a commission already earned.
French law applies, and the courts of Paris have jurisdiction. If you are a consumer rather than a business, this does not remove the protections of your own country's law.
Questions before you sign: contact@swan-club.com. We would rather answer one now than argue about a clause in six months.
